Halle Berry has been denied overnight visits with her 13-year-old son after a Los Angeles judge left ex-husband Olivier Martinez with primary physical custody amid allegations of child abuse that she fiercely denies.
The actress, 60, had hoped to return to a 50/50 custody arrangement with Martinez, also 60, but the judge rejected that request Thursday, Oct. 29, according to TMZ.
Martinez accused Berry of physically attacking their son, Maceo, during a September confrontation. Berry denied the accusations in court documents.
“I have never physically, emotionally, or otherwise abused Maceo,” she declared. “I am a victim of domestic violence, and I help victims of domestic violence.”

Although Berry did not regain equal parenting time, the judge denied Martinez’s request for a domestic violence restraining order and lifted the temporary order previously issued against her. Her attorney, Marina Beck, said she was “extremely pleased” by that outcome.
Martinez’s legal team celebrated another part of the decision, calling the custody ruling a “huge victory.”
The court heard testimony from several family members, including Maceo and Berry’s 18-year-old daughter, Nahla Aubry.
Nahla told the court she had never seen her mother become physically violent toward her younger brother.
Berry and Martinez, who separated in 2015, will continue sharing joint legal custody.
