Tay-K’s legal team is asking to temporarily pause part of his appeal as they challenge his murder conviction.
The rapper, whose real name is Taymor McIntyre, is serving an 80-year sentence in connection with the 2017 San Antonio shooting death of photographer Mark Saldivar.
His attorneys are now asking an appellate court to delay the process long enough for the trial court to explain a ruling related to the case’s evidence.
According to court filings, Tay-K’s attorneys want written “findings of fact and conclusions of law” involving a search warrant for an iPhone recovered from a vehicle connected to the investigation.
The defense has argued that the evidence should have been excluded because the warrant lacked probable cause. The trial court previously denied that motion, but Tay-K’s attorneys say the appeal cannot proceed without a clearer record.
“The need for detailed findings of fact and conclusions of law is essential to this case,” the motion states.
The filing says the trial court made “some off hand comments about the existence of probable cause,” but argues those comments are “insufficient for full and fair appellate review.”
Tay-K’s attorneys say the request is not meant to upend a July 1 briefing deadline. If the court denies the request, they are asking for a two-week extension.
Tay-K is also serving a 55-year sentence in a separate 2016 home invasion case. He is eligible for parole in 2049.
