Erika Jayne and Tom Girardi have been separated for nearly six years, but a judge now demands an explanation for why their divorce still hasn’t been finalized.
According to court documents obtained by TMZ, the Real Housewives of Beverly Hills star and her estranged husband have been ordered to appear at a hearing early next year and explain the “long delay” in their case.
If the court does not accept their reasoning, the judge could dismiss the divorce case without entering a final judgment.
Erika filed for divorce from Girardi in 2020 after more than two decades of marriage. Their split came as the once-prominent attorney’s legal and financial troubles were beginning to mount.
Girardi was later convicted of wire fraud after prosecutors accused him of stealing settlement money from former clients. In 2025, he was sentenced to 87 months in federal prison. He has also reportedly dealt with dementia and other health issues.
Erika has faced her own legal battles connected to Girardi’s business dealings, but she has repeatedly maintained that she did not know about his alleged misconduct.
The divorce has remained open throughout those legal fights.
Now, the court wants both sides to explain why the marriage is still legally intact and what, if anything, is preventing the case from moving forward.
