Kim Zolciak and Kroy Biermann’s 15-year-old son is fighting to have his serious felony case handled in juvenile court instead of facing trial as an adult.
Kroy “KJ” Biermann Jr. filed a motion in Fulton County, Georgia, asking the court to transfer his case to juvenile court and keep the proceedings confidential.
The move comes days after a grand jury indicted KJ on seven felony charges, including aggravated child molestation, aggravated sodomy, false imprisonment and multiple aggravated sexual battery counts involving a child under 16.
His attorney, Jason Sheffield, says KJ plans to plead not guilty at an October 14 arraignment.
“The evidence that I have gathered will prove, at the appropriate time and place, that KJ Biermann is not guilty of these horrific allegations,” Sheffield previously said in a statement.
KJ was arrested August 17 over an alleged April incident involving a teenage girl and has been held without bond. Sheffield has strongly disputed the accusations, previously calling his client “100% innocent.”
He is now arguing that the teenager’s age should remain central to how the case proceeds.
“Adult consequences do not transform a child into an adult,” said Sheffield. “The choices and conduct of children should not suddenly be viewed through an adult lens simply because the consequences are severe.”
KJ is scheduled to appear in court on September 11 for a hearing addressing bond and the status of the case.
