Olivier Martinez is fighting to keep Halle Berry’s daughter, Nahla Aubry, out of their custody dispute, even as he pushes for their 13-year-old son, Maceo, to tell a judge about an alleged altercation with his mother.
The 60-year-old actor challenged the involvement of Nahla, 18, in newly filed court documents Us Weekly obtained.
“Ms. Aubry is unquestionably biased,” Martinez alleged, arguing that the teenager has no real role in a case involving her younger brother.
Nahla, whom Berry shares with former partner Gabriel Aubry, recently submitted a sworn declaration supporting the Oscar winner.
“In all my years living with my mom, I have never witnessed her act violently toward anyone,” she stated.
“I am the parent who does not want to suppress Maceo’s voice,” Martinez wrote in his response.
The former couple’s legal battle escalated after Martinez accused Berry of physically attacking and choking their son during a Sept. 26 disagreement. Berry’s attorney, Marina Beck, rejected the accusations as “entirely meritless and deliberately misleading.”
Martinez then obtained a domestic violence restraining order on Oct. 1 and sought emergency changes to their shared custody arrangement.
He also alleged that Maceo feared the court would not believe his account.
The parents, who currently share 50-50 custody, are scheduled to return to court Friday, Oct. 16.
