Tiffany Haddish wants her Georgia DUI case tossed after more than four years, but prosecutors say the actress has not proven her argument.
The comedian’s January 2022 DUI arrest in Peachtree City is back in court filings, with the State of Georgia urging a judge to deny her motion to dismiss.
According to documents obtained by TMZ, prosecutors say the delay may count against the State, but they argue it was not deliberate and should not end the case.
Haddish’s attorneys previously asked for the case to be thrown out, saying the years-long wait violated her right to a speedy trial. They also claimed the pending case had affected her work as an entertainer and created issues when she was trying to travel internationally.
Prosecutors are not accepting that argument. In the filing, the State says Haddish has offered only vague claims of career damage and travel restrictions, and that she has not been sitting in a cell while awaiting the case’s progress.
The State also addressed Haddish’s position that she was ready for trial. Prosecutors say announcing she was “ready for trial” is not the same as demanding an immediate trial under Georgia law.
Haddish recently won part of a separate courtroom battle when a judge suppressed one field sobriety test and some statements tied to the arrest. Her legal team had criticized the case timeline as “unprecedented.”
