Special prosecutor Dan Webb, who is responsible for Jussie Smollett being found guilty of a hate crime hoax, says the actor’s claims he was offered a deal to avoid jail time is a lie.
Jussie says the Cook County State’s Attorney’s Office agreed that he could do volunteer community service and forfeit his bond and that his charges wuld be dropped.
In court docs, Webb says that “agreement” was “imaginary” and that he is a victim of double jeopardy.
Webb alleges protection from double jeopardy is “triggered only after the accused has been subjected to the hazards of trial and possible conviction” and that the initial charges were dropped 12 days after Jussie was arraigned and before a there was a “jury impaneled, any witnesses sworn in or evidence produced.”
A jury convicted Smollett in 2021 on five felony counts of disorderly conduct and he was given a 150-day stint in jail but spent just six days in jail while his appeal was pending.
