‘RHOP’s Karen Huger’s Request to Dismiss DUI Case Denied

Real Housewives of Potomac star Karen Huger’s request to have her DUI case dismissed.

Karen’s legal team filed a motion to suppress statements and evidence from her DUI arrest because she says that she implicated herself while in custody even though she was allegedly not read her Miranda rights.

The Grande Dame also says she was illegally searched, and evidence was illegally obtained.

“The defendant was told she was not free to leave,” the motion reads. “She was not read her Miranda warnings, indicating that the information she would provide them would be used in the filing of criminal charges against her.”

Karen was driving her 2017 Maserati when the Montgomery County Police Department pulled her over. The reality star was officially charged with driving a vehicle while impaired by alcohol and driving while under the influence of alcohol.

“The defendant’s statements were not obtained as a result of a custodial interrogation because some of her statements were made while Emergency Medical Services (EMS) personnel were treating the defendant for potential injuries,” the judge wrote in the riling. “The defendant’s statements made during this time were free and voluntary, and were stated out loud while in the presence of police officers.”

The judge added that statements obtained by the EMS personnel were not obtained as a result of a custodial interrogation “because the defendant’s subsequent statements were made while the defendant was temporarily detained pursuant to a traffic stop,” and that “The defendant’s statements should not be suppressed and the Defendant’s Motion to Suppress should be denied.”
