Tom Girardi, the estranged husband of Real Housewives of Beverly Hills star Erika Jayne, is heading to prison.
Even though Tom has dementia, U.S. District Judge Josephine Staton wasn’t swayed by medical testimony, ruling that the Bureau of Prisons is fully capable of caring for him despite his cognitive decline.
Girardi turns 86 this week.
Tom’s attorney, Sam Cross, told the court the disgraced ex-lawyer is “frail, elderly” and could be “exploited or taken advantage of” in lockup, arguing the 85-year-old needs specialized care, not prison bars.
After hearing video testimony from Bureau of Prisons experts and seeing Girardi’s flashes of self-awareness, the judge ruled the BOP could handle it.
“He will be designated to an appropriate facility,” Staton said, shutting it down.
Tom was found guilty od accused of stealing millions from vulnerable clients, including widows, orphans, and burn victims.
He allegedly funneled settlement funds to support a lavish lifestyle and finance estranged wife Erika Jayne’s career, triggering lawsuits, disbarment, and federal charges of wire fraud and criminal misappropriation.
