Lil Durk’s attorneys are asking a federal judge to block prosecutors from using evidence pulled from two phones that authorities seized after armed intruders stormed the rapper’s Georgia home in 2021.
In a new motion, the defense claims that investigators lacked authority to seize the devices because the original search warrant covered electronics belonging to the suspects, not Durk, who was the victim of the break-in, AllHipHop reports.
The early-morning home invasion occurred while Durk, his then-fiancée India Royale and their young daughter were inside. According to resurfaced body-camera footage, Royale fired at the intruders before Durk picked up the gun she dropped. The attackers fled without injuring the family.
The Georgia Bureau of Investigation later obtained another warrant to search Durk’s phones while trying to identify who might want to harm him. His lawyers argue that the reasoning did not provide a lawful basis for accessing his private data.
The defense also alleges authorities kept the phone records for five years before transferring them to the FBI. Federal agents reportedly secured their own warrant on July 8, just weeks before Durk’s scheduled Aug. 20 trial.
His attorneys want all evidence from the devices suppressed, including a text prosecutors have called a key exhibit.
Durk has pleaded not guilty to charges accusing him of arranging an attack on rapper Quando Rondo that killed Rondo’s cousin, Lul Pab, in 2022.
