Lil Durk walked away from his first federal trial with five acquittals, but he is still behind bars. Now, his attorneys want another chance to bring him home before his next courtroom battle begins.
U.S. District Judge Michael W. Fitzgerald has set a November 4 hearing to reconsider whether the Grammy-winning rapper, born Durk Banks, should remain in custody while facing a separate racketeering case connected to the 2022 killing of Stephon Mack, per AllHipHop.
The September 18ember order directs the U.S. Probation and Pretrial Services Office to appear and “provide an updated bail report to the Court.”
Durk has sought release several times without success. One proposal included more than $2 million in financial guarantees, GPS monitoring, home confinement, and round-the-clock surveillance by a private security company.
The new hearing follows Durk’s acquittal in the federal murder-for-hire case surrounding an August 2022 Los Angeles attack on Tyquian “Quando Rondo” Bowman. Bowman survived, while his cousin Saviay’a “Lul Pab” Robinson was killed.
Prosecutors are now pursuing racketeering allegations that include Mack’s January 27, 2022 shooting in Chicago. Authorities allege the killing was connected to violence involving Only The Family after Durk’s brother, Dontay “DThang” Banks Jr., was killed in 2021.
Durk has not been separately charged with Mack’s murder in Illinois. His lawyers say prosecutors lack a direct witness tying him to the killing and accuse the government of “recycling old accusations.”
No new trial date has been announced.
