Kanye West being sued by US pastor after sermon sampled without permission

Kanye West is being sued by a US pastor for allegedly sampling his sermon without permission.

Bishop David Paul Moten says that 70 seconds of his sermon was used on Ye’s Come To Life, which is more than 20% of the just over 5-minute track.

. “Approximately one minute and ten seconds of this sound recording is sampled directly from plaintiff’s sermon and appears to run on a loop underscoring the pre-chorus and chorus throughout the song in question. Consequently [at least] 20% of the entire sound recording ‘Come To Life’ is comprised of unauthorised, unlicensed samples of the sermon”.

Moten claims the rapper “wilfully and egregiously sampling sound recordings of others without consent or permission,” and that the phrase “my soul cries out hallelujah and I thank God for saving me” is heard at the start of the track and other places.

The song was featured on his Donda album.

Is the pastor right to sue?
