Will Smith is no longer facing a sexual harassment lawsuit brought by a musician who performed on his recent concert tour.
A judge officially dismissed the case this week after violinist Brian King Joseph accused Smith and members of his touring operation of misconduct connected to a 2024 stop in Las Vegas.
Joseph, who finished third on America’s Got Talent in 2018, claimed in court filings that someone broke into his hotel room during the tour and left sexually suggestive items alongside a note that read, “Brian, I’ll be back.” He later alleged he was fired after reporting the incident.
According to court documents, Judge Michael Shultz ruled Tuesday that the allegations did not amount to unlawful workplace sexual harassment.
“The allegations do not support a severe and pervasive concerted pattern of harassment sufficient to create an abusive working environment,” the ruling stated.
The judge also noted that there was no direct evidence linking Smith or his staff to the alleged break-in or to the items left behind in the room.
Joseph’s retaliation and wrongful termination claims were dismissed alongside the harassment allegations. Still, the court reportedly left the door open for the musician to amend and refile the lawsuit.
Attorneys representing Smith previously denied the accusations in court filings, calling the claims “untrue, inflammatory, legally baseless” and “nothing but an attempted money grab.”
