Olivier Martinez is seeking sole custody of the son he shares with Halle Berry after making serious abuse allegations against the actress in a new court filing.
The French actor, 60, filed for a temporary restraining order and accused Berry, 60, of physically attacking their 12-year-old son, Maceo, on September 26.
Martinez alleged Berry “physically abused our son, Maceo, by jumping on him, putting her hands around his neck, and choking him.”
He claimed the alleged incident was not isolated.
“While the September 26, 2026, incident in which Petitioner choked our son is the latest incident of abuse, I contend that there have been other instances of abuse over the course of the last few years,” Martinez alleged in the filing, also claiming Maceo called him asking to be picked up after saying Berry had “physically attacked him.”
Martinez alleged that during an argument, Berry grabbed Maceo by the neck and shouted, “Who is dominant now?! Who is dominant?”
The former couple married in 2013 and filed for divorce two years later, finalizing their split in 2023. Their custody agreement called for joint legal custody of Maceo, with Berry paying Martinez $8,000 per month in child support.
Their co-parenting relationship has previously required outside help. In 2024, Berry and Martinez agreed to participate in co-parenting therapy designed to help them work through disputes involving their son.
