Sean “Diddy” Combs has slammed a lawsuit filed against him by an inmate who accused the disgraced mogul of sexually assaulting him back in 1997.
Derrick Lee Cardello-Smith was awarded the huge lawsuit as a default Diddy, as the mogul failed to attend a virtual hearing. Still, in a recent hearing, the judge found that the inmate was unable to prove he effectively served Diddy with the lawsuit, and Diddy’s team is fighting to have the judgment overturned.
“This is a frivolous lawsuit against a prominent businessman, based on obvious fabrications, filed by a convicted rapist and serial litigant with an overactive imagination and a thirst for fame,” Marc Agnifilo, Diddy’s lawyer, wrote.
Agnifilo says the statute of limitations has passed.
Diddy’s attorney said: “Incredibly, in two different complaints filed in two different courts, [Derrick] alleges that this purported assault occurred in two different counties on the same day.” He continued, “Because the assault allegedly occurred in June 1997, any claim [Derrick] might have had expired in June 2000—more than two decades before [Derrick] commenced this litigation.”
Diddy has denied all allegations against him.
