Andy Dick will not be arrested for sexual battery following his arrest weeks ago.
“At this point, the victim is not cooperating with the investigation. So that obviously makes it difficult to continue to investigate the case,” a spokesperson for the Orange County Sheriff said.
Prosecutors cited a lack of evidence.
“If, at any time, the victim does decide that they would like to cooperate, then we would be happy to resume the investigation. But without that individual cooperation, there’s not much to go on,” the sheriff’s office said.
According to the police report, a man accused Dick of sexually assaulting him at the O’Neill Regional Park in Trabuco Canyon. The alleged victim was taken to the hospital to be examined. The comedian’s arrest was captured on Captain Content’s RV livestream on YouTube.
In 2018, Dick was accused of groping a male ride-share driver in West Hollywood. He was charged the year after with misdemeanor sexual battery.
Last year, he was arrested in L.A. on suspicion of assault with a deadly weapon in June;. He was arrested again in November after allegedly attacking his boyfriend with a liquor bottle.
