This is a bunch of bull. First of all it happened in 2008, why are we just hearing about this now. Secondly, if she was raped she would have gone to the hospital regardless of her physical condition. They could have performed a blood test in addition to the rape kit to prove she was drugged. Then even if the rape kit was did not prove the rape, the blood test would have proven she was drugged and the police would have to act regardless.
